Senate Finance Committee member Bob Kerrey, D-Neb., and Sens.
Ernest F. Hollings, D-S.C., and Dale Bumpers, D-Ark., have urged
Treasury to have the IRS issue private use regs for output
facilities. The senators point out that it has been 11 years since
the provisions were enacted, but note that some members of Congress
were responsible for the delay.

Dear Mr. Secretary:
[1] In light of the continuing attempts by some in the Congress to delay or restrict the Department's issuing of private use regulations for output facilities -- now eleven years after passage of the 1986 Tax Act -- we are writing to encourage the IRS to issue regulations as soon as possible. The guidance which these regulations are intended to provide our constituents in the management of their public power utilities would be very helpful and timely.
[2] Our hope is that these long-awaited regulations be issued immediately. We support the Treasury's efforts to bring this matter forward and appreciate the Service's diligent work on these complex regulations.
