Former U.S. Rep. Chris Cox, former Virginia Gov. James Gilmore, and NetChoice filed an amicus brief with the U.S. Supreme Court in South Dakota v. Wayfair Inc., writing that South Dakota's law violates the commerce clause by virtue of the Internet Tax Freedom Act (ITFA) and the federal policy toward internet commerce established by ITFA, and that Congress is best suited to devise a solution to complex multistate tax policy issues.
