JOINT NOTICE OF RESOLUTION OF DISCOVERY
REGARDING IDENTIFICATION OF INSPECTIONS

The Plaintiffs and United States jointly submit this notice to the Court regarding its agreement resolving the parties’ discovery dispute concerning identification of inspections. This agreement resolves the parties’ discovery dispute regarding United States’ response to Plaintiffs’ Interrogatories 12 and 13 and Plaintiffs’ response to United States’ Interrogatories 3 and 4.

1. On or before April 28, 2017, the United States will produce the following:

a. The responsive, non-privileged documents identified by parties’ agreed-upon search discussed at the parties’ April 3, 2017 phone call and memorialized by email dated April 6, 2017;

b. The EDS reports for each of the 428 class members.1

c. WebETS reports for Ronald Bell, Stephan Seok, Elizabeth Hofacre, Hilary Goehausen, Judith Kindell, and Justin Lowe for the following times: Bell (October 1, 2010, to October 1, 2014); Seok (January 1, 2011, to June 1, 2012); Hofacre (January 1, 2010, to December 31, 2010); Goehausen (July 1, 2011 to October 1, 2014); Kindell (February 1, 2010, to October 1, 2014); and Lowe (January 1, 2011 to October 1, 2014). The United States will provide definitions and/or keys for the codes used in the WebETS reports.

2. On or before April 28, 2017, the United States will amend its responses to Plaintiffs’ Interrogatories 3 and 4 to remove current objections, identify documents that Plaintiffs may consult to find responsive information, and represent that the identified documents delineate the extent of the IRS’s responsive knowledge.

3. On or before May 25, 2017, Plaintiffs will serve amended answers to Interrogatories 3 and 4 identifying the unauthorized inspections, the employees alleged to have performed such inspections, and the documents alleged to have been unlawfully inspected. Plaintiffs will further update its response to Interrogatories 3 and 4 by June 14, 2017, if necessary.
