Section 701(a) of the Public Safety Officers' Benefits Act of 1976, Pub. L. No. 94-430, 94th Cong., 2d Sess. (September 29, 1976), provides that when the Law Enforcement Assistance Administration determines that a public safety officer has died as the direct and proximate result of a personal injury sustained in the line of duty, the Administration shall pay a benefit of $50,000 to certain surviving dependents.

Held, the payment of $50,000 pursuant to section 701 of the Public Safety Officers' Benefits Act of 1976 is an amount received under a statute in the nature of a workmen's compensation act and as such is excludable from gross income under section 104(a) of the Internal Revenue Code of 1954.
