Government Watchdog Group Seeks IRS Investigation of Church's Alleged Political Activities

Dear Commissioner Everson:

Citizens for Responsibility and Ethics in Washington ("CREW") respectfully requests an immediate Internal Revenue Service ("IRS") investigation into the activities of Living Word Christian Center, based in Brooklyn Park, MN. Based on a video of a recent church-sponsored event, it appears that Pastor Mac Hammond violated federal tax law by openly endorsing state Sen. Michele Bachmann's candidacy in a U.S. House of Representatives race. Because you pledged earlier this year to investigate violations of tax law during, and not after, the election cycle, we ask that you look into this matter immediately. Pursuant to IRS procedures, CREW is also submitting this complaint to the IRS field office in Dallas.

 

IRC Section 501(c)(3) Restrictions

 

 

Public charities, including churches, are granted special privileges under federal tax law. Among these are exemption from most income tax, and the ability to confer tax-deductibility to donor contributions. In order to qualify for these desirable attributes, a public charity must be organized exclusively to engage in charitable activities, demonstrate a minimum level of public support, ensure that its lobbying activities are not a substantial part of its overall activities, and strictly avoid intervening in the elections of public officials. IRC § 501(c)(3). Should a public charity fail to meet these basic terms, the law states that it is not qualified to remain tax exempt. 26 C.F.R. § 1.501(c)(3)-1(c)(3).

Tax law absolutely prohibits public charities from participating or intervening in any political campaign on behalf of, or in opposition to any candidate for public office. 26 C.F.R. § 1.501(c)(3)-1(c)(3)(iii); United States v. Dykema, 666 F.2d 1096, 1101 (7th Cir. 1981), cert. denied, 456 U.S. 983 (1982); Association of the Bar of the City of New York v. Commissioner, 858 F.2d 876 (2d Cir. 1988), cert, denied, 490 U.S. 1030 (1989). A candidate for public office is defined as an individual who offers himself or herself, or is proposed by others, as a contestant for an elective federal, state, or local office. G.C.M. 39811 (June 30, 1989). The IRS considers all of the facts and circumstances in determining whether a public charity has illegally intervened or participated in a political campaign. See Rev. Rul. 78-248, 1978-1, C.B. 154. A public charity participates or intervenes in a political campaign if it does anything that supports or opposes a candidate through any method of distribution, including but not limited to, oral statements, or distribution of written or printed materials. G.C.M. 39811 (June 30, 1989); See also 26 C.F.R. § 53.4945-3(a)(2).

The IRS is solely responsible for enforcing the provisions of IRC § 501(c)(3). See IRC § 7801(a)(2). As a function of this enforcement authority, and a finding of increased political activities among charities and churches in 2004, the IRS has advised the regulated community of its expanded education efforts and enforcement activities. Background

 

 

On the evening of October 14, 2006, during its usual Saturday evening religious service Living Word Christian Center allowed state Sen. Michele Bachmann, a candidate for the House of Representatives seat for the sixth district of Minnesota, to speak to the congregation, including those watching via Internet webcast. Prior to welcoming Ms. Bachmann to deliver her remarks before the audience, Pastor Hammond stated:

 

I have somebody special I want to introduce you to tonight. State Senator Michele Bachmann is with us and I'm going to ask her to come in in just a moment, and of course many of you know Michele, know of her pursuit of the United States Senate seat vacated by Mark Kennedy or Congressional seat vacated by Mark Kennedy's run for a United States Senate seat. Keeping all this straight gets to be challenging. But you know we can't publicly endorse as a church and would not for any candidate but I can tell you personally that I'm going to vote for Michele Bachmann, because I've come to know her, what she stands for, and I want her to share her testimony with you tonight. Would you give her a warm welcome as she comes to share? Thank you Michele.

Although Pastor Hammond qualified his explicit endorsement of Sen. Bachmann by noting, "we can't publicly endorse as a church and would not for any candidate," this statement does not take away from the fact that the substantial resources of the Living Word Christian Center were used to provide the forum and broadcast the statement. Id. While it is legal for church leaders in their individual capacity to endorse or support campaigns, it is illegal for them to facilitate the use of church resources to do so. Pub. 1828 at 7.

Sen. Bachman's statements injected highly partisan statements in her remarks:

 

God then called me to run for the United States Congress, and I thought "What in the world will that be for?". And my husband said, "You need to do this," and I wasn't so sure, and we took 3 days and we fasted and we prayed and we said, "Lord. Is this what you want? Is this your will?". And after long about the afternoon of day two, he made that calling sure. And its been now 22 months that I've been running for United States Congress. Who in their right mind would spend 2 years to run for a job that lasts 2 years? You'd have to be absolutely a fool to do that. You are now looking at a fool for Christ. This is a fool for Christ. And in the midst of him making this calling sure, what has occurred now in this particular race is that this Congressional seat out of 435 in the country has become . . . it has been one of the top five races in the country, and in the last week this has become one of the top three races in the country, and you may have seen how God has in his own will, and his own plan, has focused like a laser beam after this scandal that came up about a week or so ago. He has focused like a laser beam in his reasoning on this race. The reason why this is one of the top three races is because this race will probably decide which way Congress goes this fall. We could talk more about what that means for this nation, what this means for defeating radical Islam, what this means for what the future of the family is going to be, what this is going to mean for the future of the freedom of religious expression.

IRS Publication 1828 notes that activity similar to that engaged in by Living Word Christian Center constitutes illegal campaign intervention:

 

Example 2: Minister F is the minister of Church O. The Sunday before the November election, Minister F invited Senate Candidate X to preach to her congregation during worship services. During his remarks, Candidate X stated, "I am asking not only for your votes, but for your enthusiasm and dedication, for your willingness to go the extra mile to get a very large turnout on Tuesday." Minister F invited no other candidate to address her congregation during the Senatorial campaign. Because these activities took place during official church services, they are attributed to Church O. By selectively providing church facilities to allow Candidate X to speak in support of his campaign, Church O's actions constitute political campaign intervention.

 

Id. at 9. CREW is not aware if the church invited Sen. Bachmann's opponent to speak at a similar service, however, given Pastor Hammond's explicit endorsement, it is unlikely that the invitation was extended.

 

Conclusion

 

 

Based on the totality of the facts and circumstances, it appears that Living Word Christian Center has illegally promoted the candidacy of Michele Bachmann in violation of IRC § 501(c)(3). CREW respectfully requests that the IRS conduct a full-scale investigation, and implement all appropriate fines and penalties, including the revocation of Living Word Christian Center's tax exempt status.

In February, before the City Club of Cleveland, you said, "Are we going to let these political activities spread to our charities and churches? Now is the time to act, before it is too late." CREW agrees, and asks that you immediately order an investigation into these activities before the end of this election cycle.
