ORDER SUSPENDING INJUNCTION

Having considered the Internal Revenue Service’s motion seeking suspension of injunction pending reconsideration and appeal, together with plaintiff's opposition thereto, the Court concludes that the motion ought to be deniedgranted. Accordingly, it is this 10th day of July, 1998,

ORDERED that the internal Revenue Service's motion seeking suspension of injunction pending reconsideration and appeal be and hereby is DENIEDGRANTED.

ORDERED that the injunctive order dated April 30, 1998, and entered herein on May 1, 1998, be and hereby is SUSPENDED for such period of time as defendant's motion to alter or amend injunctive order remains pending and for such period of time as is accorded to defendant to file a notice of appeal, pursuant to Fed. R. App. P. 4(a)(1) & (4), plus such a period of time as an appeal is pending before the Court of Appeals and for ten (10) days thereafter, or if no appeal is filed, for a period of ten (10) days after the expiration of the time in which such appeal may be filed; and it is further

ORDERED that the Clerk shall immediately give telephone notice of the filing of this order and distribute conformed copies hereof to the representatives of the parties lifted below forthwith.
